All rights, including copyright, in this website are owned by or licensed to Hurley Menswear Ltd. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Hurley Menswear Ltd . You may not modify, distribute or re-post anything on this website for any purpose.

The trade marks, names, logos and service marks (collectively "trade marks") displayed on this website are registered and unregistered trade marks of the Website Owner. Nothing contained on this website should be construed as granting any license or right to use any trade mark without the prior written permission of Hurley Menswear Ltd.

Accuracy

Hurley Menswear Ltd has taken every care in the preparation of the content of this website. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. Packaging may vary from that shown. The weights, dimensions and sizes given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery. To the extent permitted by applicable law, Hurley Menswear Ltd disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Hurley Menswear Ltd shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

Damage to your computer and / or equipment

Hurley Menswear Ltd makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and screen out anything that may damage it. Hurley Menswear Ltd shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website

Account details and passwords

You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. Hurley Menswear Ltd shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

Stock Availability

The confirmation e-mail you receive is a confirmation we have received your order and not a guarantee of stock availability. If we are unable to fulfil your order, you will be contacted and your payment will be refunded.

Prices

All our prices are in UK Pounds sterling and include VAT where applicable, at the prevailing rate. You will not be shown the postage and packing charges until you reach the checkout as this cost varies dependant upon the service that you choose.

Acknowledgement of your order

If you have supplied us with your email address, we will notify you by email as soon as possible to confirm receipt of your order and email you again to confirm details. Our acceptance of your order will take place upon despatch of the product(s) ordered.

Delays

Occasionally, the despatch of your order may be delayed. This could be for various reasons such as material shortages, import delays or higher than anticipated demand. We will, of course, make every effort to keep you informed

Cancellation right

You will only be able to exercise this right if you are able to return to us the goods you ordered unworn, undamaged and with all original labels attached as originally supplied within 7 days of receipt as per distance selling laws.

Refunds and Exchanges

Hurley Menswear Ltd will offer a refund for any item within 7 days of receipt of goods and will be happy to exchange an item up to 28 days from receipt of goods. Please return your good(s) unworn, in original condition with all garment labels intact, enclosing a copy of your original invoice by post to address below:

As a matter of hygiene refunds and exchanges are not available on underwear, earrings or any other intimate items. Please state whether an exchange or refund is required. Once your goods have been accepted back into stock you will be issued with an exchange or refund. We regret that postage and packaging cannot be refunded. However, if you are returning an item because it is damaged, we will be happy to refund the delivery charges incurred in sending the item to you, and your costs in returning to us. Hurley Menswear Ltd reserve the right to return faulty items to the manufacturer for inspection before a refund or exchange is offered. Please note that we can only refund the card originally used for payment. We regret that we cannot accept online returns to any of our branches. Your statutory rights remain unaffected by this policy.

Delivery charges

Hurley Menswear Ltd reserve the right to make any necessary amendments to the delivery charges as outlined in the delivery information document. Should any amendments effect an order placed then every effort will be made to contact you to advise you of this amendment and the reason for the amendment. At this point should you wish to cancel your order a full refund will be offered thus cancelling your order with Hurley Menswear Ltd. Exclusion of liability

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Hurley Menswear Ltd or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Our right to cancel orders

If a payment address cannot be verified with the card issuer, then we may have no option but to cancel the order. To prevent this happening, always take care when entering your address into the payment system and always use your billing address as it appears on your statement. If for any reason we cannot verify your address or suspect you are not the rightful owner of the credit/debit card, we reserve the right to cancel your order.

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
